Terms of Service

These Terms govern your use of aqatrade.com and every order you place through it. Read together with our Privacy Policy, Shipping Policy and Refund and Returns Policy, they are the whole agreement between you and us. By browsing the site or buying from it you accept them; if any part of them does not suit you, please do not use the site.

1. Who you are dealing with

Aqa Trade is the trading name of JADEPLATE LLC, based in BRYAN, OH. We sell Bath & Water Essentials products online and nowhere else. Throughout these Terms, we and us mean that company, and you means the person using the site or placing the order.

2. Eligibility to order

You must be at least 18 years of age, or have the permission of a parent or legal guardian, to place an order. You also agree that the information you give us - name, address, contact details and payment details - is accurate, current and complete, and that you will keep it up to date if it changes before delivery.

3. Products and availability

Products are described as fully and as honestly as we can manage, with materials, dimensions and capacities taken from the specification. Screens vary, so colours may not render exactly as they appear on your device. We may change, update or withdraw a listing at any time without notice, and we may limit the quantity available on a single order.

4. Pricing, tax and currency

Prices are shown on the site in US Dollars (USD) and do not include sales tax unless stated. Tax is calculated at checkout where it applies, and the full total - product price and any tax - is displayed before you confirm. Standard shipping is free, so nothing is added for delivery. We may change prices at any time, but never after you have placed an order. If a price or a description is published in error, we may cancel the affected order and refund it in full rather than honour an obvious mistake.

5. Orders and acceptance

Placing an order is an offer to buy. The confirmation email acknowledges that we received it; the contract is formed when we dispatch the goods. We may decline an order - for example where stock has run out, where the billing details cannot be verified, or where we suspect fraud - and if we do, nothing is charged, or any charge is refunded in full.

6. Payment

We accept Shop Pay, Shop Pay Installments (orders of $35 or more), Apple Pay, Google Pay, PayPal, Visa, Mastercard, American Express, Discover, Diners Club, Elo, JCB, and UnionPay. Payment is taken at checkout through Shopify Payments, over an encrypted connection, and full card details are never stored on our servers. All charges are shown before you confirm; there are no hidden fees.

7. Cancelling an order

If you need to cancel, email support@aqatrade.com as soon as possible with your order number. We process orders quickly, so an order that has already been packed or dispatched may not be cancellable - in that case the Refund and Returns Policy applies instead.

8. Shipping

We ship within the United States only, to all 50 states, using a single free standard service. International shipping and expedited shipping are not offered. Delivery windows are estimates given in good faith and not guarantees; once a parcel is with the carrier, its progress is outside our control, though we will chase it on your behalf. 9. Returns and refunds

Returns are accepted for manufacturing defects, damage in transit and incorrect items, within the timeframes set out in the Refund and Returns Policy. Change-of-mind returns are not accepted. Please read that policy before ordering; it forms part of these Terms.

10. Your account

If you create an account, you are responsible for keeping your login details to yourself and for anything done through your account. Tell us at support@aqatrade.com immediately if you think someone else has access to it.

11. Acceptable use

When using the site you agree not to:

• Use it for any unlawful or fraudulent purpose.
• Interfere with its operation or security, or attempt to gain access to any part of it you are not authorised to reach.
• Scrape, copy, republish or resell its content without our written permission.
• Upload or transmit malicious code of any kind.
• Place orders using payment details that are not yours to use.

12. Intellectual property

The text, product photography, layout, graphics and other content on the site are owned by or licensed to Aqa Trade and are protected by copyright, trademark and other intellectual property law. You may view and print pages for your own personal use. Any other reproduction, distribution or commercial use requires our prior written consent.

13. Disclaimer of warranties

The site and its content are provided on an as-is and as-available basis. We do not warrant that the site will be uninterrupted, timely, error-free or free of harmful components, nor that every description is complete or current at every moment. Nothing here removes any warranty or right that cannot lawfully be excluded.

14. Limitation of liability

To the fullest extent the law permits, Aqa Trade and JADEPLATE LLC are not liable for indirect, incidental, special, consequential or punitive damages arising out of your use of the site or your purchase of any product, including loss of data, loss of revenue and loss of profit. Where liability cannot be excluded, it is limited to the amount you paid for the order that gave rise to the claim.

15. Indemnity

You agree to indemnify and hold harmless JADEPLATE LLC, its officers and its staff against any claim, loss or expense arising from your breach of these Terms or your misuse of the site.

16. Privacy

Your use of the site is also governed by our Privacy Policy, which explains what we collect, why we hold it and who else sees it.

17. Changes to these Terms

We may revise these Terms from time to time. The current version is always the one posted on this page, with its effective date; continuing to use the site after a change means you accept the revised Terms. The version in force when you placed an order is the one that governs that order.

18. Governing law

These Terms are governed by the laws of the State of Ohio and of the United States. Any dispute arising from them, or from your use of the site, is to be brought in the courts of State of Ohio.

19. Severability

If any provision of these Terms is found unenforceable, the rest remain in force and the unenforceable part is to be read as narrowly as necessary to make it valid.
